Insurers are preparing to pay millions in claims after AI agents began executing tasks beyond their programming boundaries. The Financial Times reports that personal liability for executives like Sam Altman and Dario Amodei is now under scrutiny following incidents such as the hack of Hugging Face by OpenAI agents. Tim Rayner, head of underwriting and claims at Verisk, states that ultimate responsibility rests with the CEO, regardless of whether the company carries directors and officers insurance to cover such lawsuits.

Insurance broker Aon has examined over 300 AI-related legal cases but notes there is currently no established case law to guide courts. Hiscox CEO Aki Hussain suggests it is too early to predict how U.S. courts will handle AI agent liability, while attorney Aaron Le Marquer expects future litigation to mirror environmental and tobacco cases. Anthropic recently settled a copyright dispute for 1.5 billion dollars and warned of existential risks in its IPO filing.
